Helical Pile Installations
1. Appointment Cancellation Fee
A cancellation fee of $150 will be charged for any appointment that is not canceled before the crew has loaded materials or arrived on-site on the scheduled day of installation.
2. Non-Removable and Non-Refundable Installations
All installed helical piles are permanent, non-removable, and non-refundable. Once the installation is completed, no refunds or removals will be provided under any circumstances. Any request for the removal of installed helical piles or materials will result in a separate charge, in addition to any other applicable charges.
3. Extra Work and Overage Charges
Any additional work performed outside the scope of the original estimate, including but not limited to unforeseen site conditions or necessary adjustments, will be subject to overage charges. These charges will be discussed with and approved by the client before proceeding.
4. Project Costs and Cancellations Due to Overages
If the client chooses not to proceed with additional overage costs, the total project cost will include all work completed up to the point of cancellation. Additionally, the client will be responsible for any custom-ordered or fabricated materials and any specialized tools acquired specifically for the job.
5. Cancellation Policy
Clients may cancel their appointment at any time prior to the conditions outlined in Section 1. Once the crew has loaded materials or arrived on-site, the cancellation fee will apply.
6. Utility Location Responsibility
It is solely the property owner’s responsibility to ensure that all utilities are properly located prior to installation. While the contractor may schedule a public utility location service, this does not guarantee that all utilities will be identified. It is at the owner’s discretion to hire a private utility locator or provide utility locates for all privately owned infrastructure, including but not limited to power, gas, data, irrigation, drainage, or any other underground facilities that may be present in the installation area. The contractor will not be held liable for any damage to utilities that have not been properly identified or located by the property owner.
7. Material Deposits
Material deposits may be required for certain projects, including but not limited to those involving more than four helical piles, projects that require custom work or products, and projects with long travel distances exceeding 45 minutes from the contractor's shop. The deposit amount will be determined based on the specific requirements and scope of the project. This deposit ensures the commitment to the project and secures necessary materials and resources. The deposit will be credited toward the final project cost upon completion.
8. Steel Market Pricing
Due to ongoing volatility in the global steel market, all pricing provided by GoliathTech, including estimates for large bid projects and custom products, is based on current steel costs and is subject to change. The price quoted reflects market conditions on the date of issuance and is not guaranteed beyond that day.
Pricing remains subject to fluctuations until an official order for materials is placed. At the time of order confirmation, the pricing of materials will be reviewed and adjusted accordingly based on current market conditions. Any fluctuation in material pricing will be reflected in the final quote, which will be provided for approval.
Once the final quote is approved (within 24 hours) and the order is confirmed, the price of materials will be fixed and no longer subject to change.
GoliathTech and its franchisees shall not be held responsible for any adjustments in material costs that occur before an official order is placed. Clients are encouraged to confirm their orders as soon as possible to secure pricing.
By scheduling an appointment for helical screw pile installation, the client agrees to the above terms and conditions.
Construction Projects
1. Agreement Overview
These Terms and Conditions (“Agreement”) apply to all construction services (“Projects”) provided by 4Rest Decks and Piles (“Contractor”) to the Client (“Customer”). By engaging the services of the Contractor, the Client agrees to abide by the terms outlined below.
2. Scope of Work
The Contractor will provide design, construction, and related services as agreed upon in the estimate and design documents specific to each Project. The exact scope of work, materials, design plans, and estimated costs will be outlined in these documents. The Contractor will provide all necessary labor, materials, and equipment required for the successful completion of the Project.
3. Project Timeline
The timeline for each Project will be established in the specific estimate and design documents. While the Contractor will strive to meet the agreed-upon timeline, delays due to weather, supply chain issues, or other unforeseen circumstances will not be held against the Contractor.
4. Payment Terms
Payment terms for each Project will be agreed upon once an estimated price is provided and accepted by the Client. Unless otherwise specified, a deposit is required before any work begins, with the balance due upon completion or according to the agreed-upon schedule. All payments are to be made according to the terms set forth once the estimated price is agreed to.
5. Changes to the Scope of Work
Any changes to the scope of work must be requested in writing by the Client and approved by the Contractor. Additional costs or adjustments to the Project timeline will be communicated to the Client and agreed upon in writing before such changes are implemented.
6. Permits and Approvals
It is the responsibility of the Client to ensure that all necessary permits and approvals are obtained prior to the commencement of the Project, unless otherwise stated in the estimate and design documents. The Contractor will assist in acquiring any necessary permits or approvals if specified in the documents.
7. Warranty
The Contractor provides a warranty for workmanship and materials as specified in the individual project agreement. The warranty covers defects in materials or labor directly attributable to the Contractor’s work. It does not cover damage caused by misuse, external conditions, or natural wear and tear.
8. Liability and Insurance
The Contractor is covered by liability insurance for the duration of the Project. However, the Client is responsible for the safety of the worksite and surrounding area. The Contractor is not responsible for damage caused by third parties, weather, or other external events.
9. Termination of Agreement
Either party may terminate this Agreement with written notice if the other party is in material breach of any terms outlined. In the event of termination, the Client will be responsible for payment for all work completed to date, and any outstanding issues will be resolved as mutually agreed.
10. Dispute Resolution
Any disputes arising from the terms of this Agreement shall first be addressed through informal discussions between the Contractor and the Client. If an agreement cannot be reached, both parties agree to enter into mediation or arbitration before seeking other legal recourse.
11. Governing Law
This Agreement shall be governed by the laws of Alberta, Canada, and any disputes will be resolved in the appropriate courts of Alberta.
12. Final Acceptance
Upon the completion of any Project, the Client will inspect the work and provide written acceptance. Any discrepancies or unresolved issues will be addressed by the Contractor in a timely manner.
